At Gamoniz, we aim to provide a seamless experience for buyers and sellers. This policy outlines the conditions under which refunds and returns are handled on our platform.
Application of the Terms of Services
The present Refund Policy is intended to be read in conjunction with the Platform’s Terms of Service. The Terms of Service provide an overview of the Buyers and the Sellers’ obligations, permitted and prohibited Products, the Company’s limited liability, disclaimers, and other provisions relating to the usage of the Platform.
Both the Terms of Service and the present Refund Policy apply to the usage of the Platform as well as the sale and purchase of Products thereon. For reference purposes, both the Terms of Service and this Policy are published and available for review on the Platform.
In case of any discrepancy or contradiction between the present Refund Policy and the Terms of Service, the present Refund Policy shall prevail with respect to refunds of Products, refund requests and chargebacks.
1. Seller-Specific Policies
1.1 Seller Policies
Each seller on our platform is responsible for setting their own refund and return policies. We encourage buyers to review the seller’s policy on the product page before making a purchase.
1.2 Absence of Seller Policies
If a seller has not specified their own refund and return policy, the default policy outlined in Section 2 will apply.
2. Default Refund & Return Policy
2.1 Refund Eligibility
In the absence of a specific seller policy, buyers may request a refund if:
- The item received is significantly different from its description.
- The item was not delivered.
- If the seller cannot provide the order within the promised timeframe, the buyer may refuse delivery and request a full refund.
If the buyer accepts delivery, they may negotiate with the seller for a partial refund or coupon.
Otherwise, the commission fee will not be refunded to buyer if he requests cancellation for no good reason.
2.2 Return Process
To initiate a return, buyers must contact our customer support with their order details and reason for the return. Our team will provide further instructions.
2.2 Return after purchase
By default, once delivered items cannot be returned to seller, unless specified in his return and refund policy.
2.3 Seller Obligation
Sellers must respond to return or refund requests promptly.
3. Marketplace Guarantee
3.1 Buyer Protection
Gamoniz offers a guarantee to buyers in case the seller fails to deliver the item within the specified timeframe. If the seller is unable to fulfill the order as promised, we will issue a full refund to the buyer.
If you are approved, then your refund will be processed, and a credit will automatically be applied to wallet (Gamoniz credit) or original method of payment, within 10 days.
3.2 Claim Process
To file a claim under our marketplace guarantee, buyers should contact customer support within 72 hours after the expected delivery date. We will investigate the claim and process the refund if the criteria are met.
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us.
4. Chargebacks
4.1 Handling Chargebacks
If a buyer initiates a chargeback without valid reasons (i.e., the product was delivered as described and on time), the buyer will be responsible for the repayment of the cost of the order and any associated fees. This acts as a deterrent against unwarranted chargebacks and protects sellers who have fulfilled their obligations.
4.2 Fees for Chargebacks
If the seller lacks in his obligation to deliver the described product and the buyer initiates a chargeback, Gamoniz shall charge the Seller a fixed fee of nineteen Euros (19€) for every refund chargeback instituted by a Buyer of the Seller’s Product(s), regardless of the outcome. The Seller shall be responsible for paying such fixed fee upon the submission of the refund request, or Gamoniz may withdraw such fee from the Seller’s merchant balance, at Gamoniz’s discretion. The amount subject to the chargeback shall then be removed from the Seller’s merchant balance.
In the event that the chargeback is maintained by the banking institution, thereby resulting in a loss for Gamoniz, it reserves the right to institute legal action against the Buyer in addition to the 19€ fee for each unwarranted chargeback. The prevailing party shall be entitled to recover reasonable attorney fees and legal costs.
Exceptions
Certain items may not be eligible for refunds due to their nature or items marked as non-refundable by the seller. We recommend reviewing the product listing and seller’s policy carefully before purchasing.
Changes to This Policy
We reserve the right to update or modify this Refund & Return Policy at any time. We will notify users of significant changes by posting a notice on our platform or sending an email. Continued use of our platform constitutes acceptance of the updated policy.
